Terms and conditions

1. Who we are

These terms apply to every order placed with Dixels B.V., registered with the Dutch Chamber of Commerce under 59974907, VAT number NL853716833B01, with its registered office at Slenterweg 3, 6905 DM Zevenaar. You can reach us at info@dixels.com.

2. Definitions

We, us, our: Dixels B.V.. You, customer: the person who places an order. Service: turning a photo or description you provide into AI-generated artwork. Artwork: the AI-generated result. Digital product: the artwork as a downloadable file. Physical product: a printed version of the artwork shipped to you.

3. The service

We use AI to create artwork based on the photo or description you provide. The artwork is openly AI-generated. You can buy it as a digital download and, optionally, as a physical print produced by a print partner.

4. Ordering and account

You can order without an account. An agreement is concluded once you complete checkout and we confirm your order. We may refuse an order if it conflicts with these terms or our acceptable use rules.

5. Prices and payment

Prices are shown before you order and include VAT. Payment runs through our Shopify checkout, handled by our payment provider Shopify (Shopify Payments: iDEAL, Klarna, creditcard). Your order is processed once payment is confirmed.

6. Delivery

Digital products are delivered immediately after payment is confirmed, by download or by a link sent to your email.

Physical prints are printed and shipped by us from our own studio in the Netherlands. Orders placed before 22:00 are shipped the next business day; delivery after that usually takes 1 to 2 business days within the Netherlands, depending on the carrier. This is an estimate and not a fixed deadline.

7. Your usage license

For personal use you receive a personal, non-exclusive usage license to your artwork, so you can print it, display it and share it with family and friends. We do not transfer or guarantee copyright in the artwork. For commercial use you need a separate license, which we arrange through our business route. More detail is on the AI and copyright page.

8. Your warranties about the photo

You warrant that you hold the rights to the photo you upload and that any person shown has given consent to its use, in line with their portrait rights (portretrecht). You will not upload content that is unlawful, infringing or that you have no right to use. You indemnify us against third-party claims that arise from the material you provide.

9. AI results may vary

The artwork is AI-generated, so the exact outcome can vary and is, by its nature, not fully predictable. This is part of the product. If you are not happy with the first result, we offer free refinements before any physical product is produced, so we can get the artwork right with you.

You approve the artwork yourself before you order. The free preview shows exactly what you will receive, and by placing your order you confirm that the design is as you want it. Because the print is then produced to that approved design, we cannot refund a print afterwards simply because you would have preferred a different result. Production defects and transport damage are of course always covered.

10. Acceptable use

You may not use our service to create images that are unlawful, deceptive, hateful, sexual involving minors, or that infringe the rights of others. We may refuse or stop a request that falls under this and, where needed, report serious abuse.

11. Liability

We do our best to deliver a good result, but the outcome of AI can vary. To the extent permitted by law, our liability per order is limited to the amount you paid for that order. This does not limit liability that cannot be excluded by law, such as for intent or gross negligence. Your statutory consumer rights remain unaffected.

13. Complaints

Do you have a complaint? Contact us at info@dixels.com and we will respond as soon as we can and at the latest within 14 days. You can also use the European ODR platform at ec.europa.eu/consumers/odr.

14. Applicable law

Dutch law applies to these terms and to every agreement with us. Any dispute will be submitted to the competent Dutch court, unless mandatory law points to another court. This does not affect the protection that mandatory consumer law gives you.

15. Changes

We may change these terms. The version that applies to your order is the one in force at the time you order.
